Brian Burbrink is an experienced litigator and counselor. With a particular focus on labor and employment litigation and counseling, Brian represents management in a broad variety of matters, including:

Individual claims in agency and court actions. Defends clients in administrative proceedings and in federal and state court litigation against claims of age, race, sex, and disability discrimination, wage and hour violations, and retaliation, among others. Has obtained numerous favorable summary judgment rulings in such cases. Prosecutes and defends claims involving non-compete and non-solicitation agreements, misappropriation of trade secrets, and other forms of unfair competition.

Class and collective actions. Defends cases alleged as collective and class actions, including numerous FLSA collective actions and other multi-plaintiff cases.

Administrative Proceedings. Represents employers in proceedings before the Equal Employment Opportunity Commission and the US Department of Labor, among other agencies.

Mediations and negotiations. Represents employers and corporate clients in formal, court-ordered settlement conferences and mediation programs and in informal, voluntary claim resolution negotiations.

Terms of Employment. Advises clients regarding compliance with federal, state, and local law, including Title VII, ADA, ADEA, FLSA, FMLA; assists clients in conducting investigations of harassment and employee misconduct; enforces confidentiality agreements and non-compete agreements, and defends related claims.

Policies and practices. Drafts employment contracts and severance agreements, disciplinary notices, employee manuals and handbooks, non-compete and non-solicitation agreements, and other employment-related documents.

In 2016, Brian served as Chair of the Indianapolis Bar Association’s Labor and Employment Section.  Brian was selected as an Indiana Super Lawyer, Rising Star for 2017 and 2018, in employment litigation defense, an honor bestowed on only 2.5 percent of lawyers in the State of Indiana.  Brian is also involved in pro bono work.  He obtained a defense verdict for a pro bono client in a bench trial involving real estate disclosures.  Brian also obtained asylum on behalf of an unaccompanied alien child from Ethiopia.

Nicole E. Broch, CIC, CISR, PLCS spent over a decade as an Independent Insurance Agent and Manager of a successful partnership between a community financial institution and a local independent agency in Springfield, Illinois.  She attended The Hartford School of Insurance and achieved her National Underwriter awarded Personal Lines Coverage Specialist (PLCS) designation in 2005.  She went on to receive the National Alliance CISR designation in 2007 and CIC designation in 2009.  

In addition to teaching National Alliance CISR modules, IIABA Errors & Omissions, Ethics, and customer service and professional development topics for IIAs, PIAs, and trade associations throughout the country, she is the Territory Sales Manager for The Hanover Group, supporting independent agents throughout Central and Southern Illinois.  

Originally from Florida, Nicole has a Bachelors degree in English from Florida State University and a Masters degree in Public Administration from the University of South Florida.  

Nicole has two children, Natalie and T.J., and enjoys playing golf, running, spending time with family, and volunteering in her community and in the insurance industry.

Kelly Donahue-Piro, founder and president of Agency Performance Partners, is a no-nonsense effectiveness expert who has helped hundreds of insurance agencies identify and capitalize on sustainable improvement opportunities. Her specialties include agency culture assessment and change; management and supervisory coaching and benchmarking; customer retention strategy development; digital marketing strategy, planning and implementation; and sales planning, management and skill-building. Over the past several years, Kelly has worked with small businesses across the country to build and implement successful programs to boost revenues, profits and efficiency. In 2014, she created Agency Performance Partners with a mission to “partner with insurance entrepreneurs who dream to take their business to the next level and beyond, by relentlessly pursuing excellence in world-class service and sales strategies.”

The centerpiece of the organization’s transformational work is its Agency Performance AssessmentTM, a comprehensive survey tool Kelly created to zero in on organization-wide improvement opportunities and provide the foundation for a customized agency action plan. The proprietary tool addresses everything from agency mission, goals, values and culture to agency management and infrastructure, employee abilities, service processes and procedures, and marketing, sales and retention strategy. Kevin Amrhein is president of the Florida Insurance School of Continuing Education (FISCE) and the CE Partnership. He is an education consultant for Independent Agents & Brokers (IA&B) – an association representing insurance professionals in PA, MD and DE. For IA&B, he creates and teaches coverage courses and produces a monthly column/podcast on coverage issues.

In addition to working with IA&B, Kevin creates and teaches courses for various insurance organizations and trade associations. He started his insurance career as a marketing intern before pounding the pavement as a commercial lines agent in Orlando, FL. He is a national faculty member for the National Alliance for Insurance Education and Research’s CIC and CISR designation programs. As an industry journalist, his articles have appeared in a variety of trade publications. His insurance television career, short-lived but quite glorious, once saw him serve as the expert adviser on an insurance-themed infomercial (yes - you read that correctly).

Kevin is a graduate of the University of Central Florida. His first teaching gig was as a golf instructor where he was frequently kicked off driving ranges for giving free lessons. He lives in Tallahassee, Florida with his absurdly beautiful wife and daughter.

Richard S. Pitts is Vice-President and General Counsel to Arlington/Roe & Co., Inc., an insurance brokerage and managing general agent headquartered in Indianapolis. Rick also serves as general counsel to the Independent Insurance Agents of Indiana, Inc. As counsel to the “Big I,” Rick speaks annually at the association’s New Laws Seminars and teaches various seminars on insurance and employment related matters. Pitts has also presented continuing education seminars to insurance professionals nationally and in states such as Illinois, Kentucky, Michigan, Ohio, Kentucky, and Tennessee. 

Rick is a 1983 graduate of Wabash College and a 1986 graduate of Indiana University School of Law – Indianapolis. Pitts clerked for the Honorable Patrick D. Sullivan, a judge of the Indiana Court of Appeals in 1986-87. Rick is admitted to practice before Indiana state and federal courts, the United States Supreme Court and the United States Court of Appeals for the Seventh Circuit and is a member of local, state and national bar associations. Pitts has tried cases and participated in over seventy appeals. 

Pitts has served as a panelist and lecturer on a variety continuing education subjects, including the Americans with Disabilities Act, “Mold: Issues Under the Microscope” for the Indiana Continuing Legal Education Forum (ICLEF), and “Insurance Issues for Builders” for the Indiana Builders Association. Rick has also served as chair of several of ICLEF’s seminars, including “Advanced Corporate Practice,” “Privacy Law,” and “Insurance Coverage Issues.” Rick has also presented seminars on “Insuring Fiduciary Exposures,” “Insurance Coverage Disputes,” and “Agency Succession and Perpetuation,” or the Independent Insurance Agents of Indiana, 2007. Pitts has co-authored two articles appearing in the Indiana Law Review. 
In 2014, Rick began teaching programs for The National Alliance for Insurance Education & Research.
